Markham General Insurance Company In Liquidation

This is to advise that the Ontario Superior Court of Justice has authorized the Liquidator of Markham General Insurance Company to enter into a loan agreement with Facility Association to borrow from Facility Association such amounts as the Liquidator may reasonably require to enable the Liquidator to ensure prompt payment and administration of Ontario Statutory Accident Benefits.

The court has also held that, when such agreement is entered into, any claim by Facility Association for the repayment of the loan is secured on the assets of Markham General Insurance Company, and ranks on a pari passu basis, with loss claims that have arisen under insurance policies, and Facility Association is deemed to be a policyolder for the purpose of securing repayment of the loan.

The Agreement is in effect.
